Terms of Use
These Terms of Use ("Terms") govern your access to and use of Kids Writing ("Service"), operated at kidswriting.ai ("we", "us", "our"). By registering for or using the Service, you ("you", "your", "User") agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility & Registration
You represent and warrant that you are at least 13 years old (or the minimum age in your jurisdiction) and, if under the age required to form a binding contract in your jurisdiction, that your parent or legal guardian has reviewed and accepted these Terms on your behalf.
If you are using the Service on behalf of an organisation (such as a school or tutoring centre), you represent that you have authority to bind that organisation and agree to these Terms on its behalf.
You agree to provide accurate, current and complete information when registering, and to maintain the confidentiality of your account credentials. You are responsible for all activity under your account, whether or not you authorised it. You must notify us immediately of any unauthorised use or security breach.
2. The Service & Licence
Kids Writing provides an AI Writing Tutor, essay feedback, rubric-based scoring, progress tracking, interactive lessons, and related educational tools.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Service. We retain all rights, title and interest in the Service (including software, infrastructure, content, trademarks and intellectual property) other than your data as described below.
We may modify, update or discontinue the Service (or any feature) at any time. Where practicable, we will give reasonable notice of material changes.
3. Your Data & AI Outputs
"Your Data" means all content you submit to the Service, including essay text, writing prompts, uploaded documents, and account information.
You retain ownership of Your Data and of the feedback, scores and reports ("Outputs") generated from Your Data.
You grant us a non-exclusive right to use, process, aggregate and anonymise metadata and usage data generated through your use of the Service, in order to improve, develop and operate the Service, provided such data does not identify you individually.
You represent and warrant that you have all necessary rights and permissions to submit Your Data and to allow us to process it via the Service.
AI Disclaimer: The Service uses artificial intelligence which may produce inaccurate, incomplete or unexpected Outputs. You agree to review, verify and validate all Outputs before relying on them. We do not guarantee the accuracy, reliability or suitability of any Output and accept no liability for errors, omissions or damages arising from your reliance on or use of any Output. Outputs are for educational purposes only and should not replace professional assessment or teaching.
AI Model Training: We do not use your personal essays or submissions to train AI models. Your essays are processed by third-party AI providers (such as OpenAI) solely to generate feedback for you. We may use anonymised, aggregated usage data to improve the Service, provided such data cannot be used to identify you or your original work.
4. Children's Use & Parental Responsibility
Kids Writing is designed for use by students, including children under 18, under the supervision of a parent, guardian or teacher. If you are a parent or guardian registering on behalf of a child, you accept these Terms on their behalf and agree to supervise their use of the Service.
We do not knowingly collect personal information from children under 13 without parental consent. If you believe a child under 13 has provided personal information without consent, please contact us and we will delete it promptly.
Children's privacy defaults: All accounts are created with the highest privacy settings by default. We do not track location, we do not serve targeted advertisements, and we do not share children's data with third parties for marketing purposes. Children's essay submissions are processed solely to generate feedback and are not used for AI model training, profiling, or any purpose other than delivering the Service.

5. Acceptable Use
You agree not to:
- Use the Service for any illegal, unlawful, fraudulent or harmful purpose
- Submit content that infringes third-party intellectual property or privacy rights
- Attempt to reverse-engineer, decompile or extract source code from the Service
- Use the Service to generate content that is harmful, abusive, or inappropriate for minors
- Share your account credentials with others or allow unauthorised access
- Use automated tools, bots or scrapers to access the Service at scale
- Interfere with or disrupt the Service or its infrastructure
We may suspend or terminate your access immediately if we reasonably believe you are in breach of this section or any other provision of these Terms.
6. Academic Integrity
Kids Writing is designed to be a writing improvement tool — it helps students learn from feedback, not bypass the learning process. You represent and warrant that you will use the Service in a manner consistent with the academic integrity policies of your school, university, or other institution.
You agree not to:
- Represent AI-generated feedback, corrections, or text as your own original work
- Use the Service to commit plagiarism, cheat, or otherwise engage in academic misconduct
- Submit work that has been substantially rewritten by AI for academic credit without proper disclosure or permission from your teacher or institution
We encourage students to use the feedback to understand their mistakes and improve, not to copy corrected text. Teachers and parents should supervise usage to ensure the tool supports genuine learning.
We reserve the right to investigate and terminate accounts that we suspect are being used in violation of academic integrity policies.
7. Fees, Billing & Cancellation
The Service offers free and paid subscription plans. Pricing is described on our Pricing page. You agree to pay all applicable fees in a timely manner.
Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. If you cancel your subscription, you will continue to have access until the end of your current billing cycle.
Unless otherwise stated, subscription fees are non-refundable. We reserve the right to change fees for any renewal term, provided we give you prior notice and you have the opportunity to cancel before the fee change takes effect.
Free plan usage is subject to limits (e.g., 12 essay markings per month). We may adjust these limits at our discretion.
7A. Referral Program
We may offer a referral program that allows you to invite new users with a personal referral link. Unless otherwise stated, referral rewards are only issued after the invited user creates an account and completes their first successful paid subscription checkout.
Referral rewards are promotional credits only, are not redeemable for cash, and may not be transferred or sold. We may place expiry dates, usage limits, and eligibility requirements on rewards at our discretion.
You must not self-refer, create multiple accounts, use fake identities, or engage in any fraudulent behavior to obtain rewards. We may withhold, reverse, or cancel rewards and suspend accounts where we reasonably suspect abuse.
We may modify, pause, or end the referral program at any time.
8. Termination & Suspension
You may stop using the Service at any time. You can cancel your subscription through the Stripe customer portal or by contacting us.
We may suspend or terminate your access (in whole or in part) immediately without notice if you breach these Terms, engage in illegal or harmful conduct, or we reasonably believe you are misusing the Service.
Termination will not relieve you of amounts owing to us. Sections that by their nature survive termination (e.g., Data ownership, Fees, Limitation of Liability, Governing Law) will continue to apply.
9. Intellectual Property
You own Your Data and the Outputs derived from it (subject to the rights granted to us in Section 3).
All rights, title and interest in the Service — including software, documentation, website design, trademarks, trade names and content not created by you — remain our exclusive property or the property of our licensors.
You must not copy, modify, distribute, sell, lease, reverse-engineer, decompile or create derivative works of the Service or any part of it, except to the extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or your use of the Service is limited to the total amount you have paid to us in the twelve (12) month period immediately preceding the event giving rise to the claim.
We are not liable for any indirect, special, incidental, consequential or punitive damages (including lost profits, loss of data, loss of business or goodwill), even if we have been advised of the possibility of such damages, except to the extent prohibited by law.
Nothing in these Terms limits or excludes your rights under the Australian Consumer Law or other applicable statutes that cannot be excluded (such as non-excludable statutory guarantees).
11. Indemnity
You agree to indemnify, defend and hold harmless Kids Writing, its officers, directors, employees, agents and affiliates from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your submission of data or use of the Service or Outputs
- Any claim that Your Data infringes third-party rights
- Your violation of applicable laws or regulations
This does not apply to the extent caused by our gross negligence or wilful misconduct.
12. Privacy & Data Protection
Our collection, use, processing and protection of personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Service you agree to the terms of our Privacy Policy and consent to our processing of your personal information in accordance with that policy.
13. Disclaimers
The Service is provided "as-is" and "as-available". We expressly disclaim all warranties not required by law. We make no warranty that the Service will be uninterrupted, error-free or secure, or that results will meet your expectations.
You acknowledge that artificial intelligence is inherently uncertain and may produce flawed outputs. You accept full responsibility for reviewing Outputs and for any consequences of using them.
The Service is an educational tool and does not replace qualified teachers, tutors or professional assessment. Scores and feedback are generated by AI and should be used as a guide for improvement, not as a definitive assessment.
14. Automated Decision-Making & Transparency
The Service uses automated decision-making (AI-generated scoring and feedback) to evaluate student writing. We are committed to transparency about how this works:
- How scoring works: Your essay is evaluated by an AI language model against a structured rubric (a set of specific criteria). Each criterion is scored independently on a 1-10 scale. The overall score is derived from these individual criterion scores.
- What the AI sees: The AI receives your essay text, the writing prompt, your selected exam type, and your grade level. It does not receive your name, email, or any other personal information.
- Limitations: AI scores are indicative, not definitive. They may differ from human marker scores. The AI may occasionally produce inaccurate feedback. Scores should be used as a guide for improvement, not as an official assessment.
- Human oversight: We encourage parents and teachers to review AI feedback with students. The Service is designed to support human decision-making, not replace it. No high-stakes decisions (school placement, exam results, academic grading) should be based solely on AI-generated scores from this Service.
15. Third-Party Services
The Service may integrate with or link to third-party services (such as Stripe for payments and OpenAI for AI processing). Your use of those third-party services is subject to their own terms and policies. We are not responsible for third-party services, their content, actions or omissions.
16. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will provide notice (for example via email or through the Service). Continued use of the Service after revised Terms become effective constitutes your acceptance. If you do not agree with revised Terms, you should stop using the Service.
17. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising out of or relating to these Terms or your use of the Service.
18. Severability & Entire Agreement
If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be modified to the minimum extent necessary to make it valid, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and any other documents referenced herein, constitute the entire agreement between you and us regarding the Service.
